GENERAL TERMS AND CONDITIONS OF SALE
ESI Isola 2000 Ski School
1. Purpose and Scope
These General Terms and Conditions of Sale (hereinafter the “GTC”) govern the contractual relationship between the ESI Isola 2000 Ski School (hereinafter “ESI School”) and any person making a reservation for services (hereinafter the “Client”).Any reservation implies the Client’s full, unconditional and unreserved acceptance of these GTC.The applicable GTC are those in force on the date of purchase of the services.
They may be consulted at any time on the ESI School’s website and at its offices.
Any conditions set forth by the Client that conflict with these GTC shall be unenforceable against the ESI School unless expressly accepted in writing by the latter.
2. Opening Period
The ESI Isola 2000 Ski School is open from December 6, 2025 to April 21, 2026, subject to snow conditions and the opening of the resort.
3. Services Offered
The services offered are those presented on the ESI School’s website and at its offices, including in particular:
• ski and snowboard lessons,
• snowshoeing and off-piste outings,
• private lessons, group lessons, or shared private lessons.
All services are available by reservation only and subject to availability.
4. Conditions of Participation
Participation in instructional services requires that the Client:
• be in good physical condition (in case of doubt or special circumstances, the Client must contact the ESI School),
• have suitable winter sports equipment,
• strictly follow the instructions given by the instructors.
The Client acknowledges meeting these conditions and participating in the services under their own responsibility.
The Client releases the ESI School, its management, instructors, and members from all liability for any injury or damage caused to themselves or to third parties in connection with participation in the services, except in cases of gross negligence or intentional misconduct.
5. Supervision and Safety
Lessons are conducted by state-certified instructors qualified in their respective disciplines.
Participation in lessons is subject to the instructors’ assessment, particularly with regard to:
• technical level,
• physical ability,
• weather and snow conditions.
Instructors have means of communication with the ski patrol and the ESI School office.
The ESI School reserves the right to modify or cancel a service for safety reasons, without entitlement to compensation, unless otherwise provided for in these GTC.
6. Weather Conditions
Weather conditions do not constitute grounds for cancellation or postponement at the Client’s initiative insofar as the services are maintained by the ESI School.
No refund or rescheduling may be claimed by the Client on this basis.
7. Insurance
The services do not include any insurance.
It is the Client’s responsibility to take out personal insurance covering at least:
• bodily injury,
• rescue costs,
• repatriation,
• and, where applicable, lesson cancellation,
in accordance with Article L.321-4 of the French Sports Code.
8. Booking Process
8.1 Booking Methods
Reservations may be made:
• directly at the ESI School offices,
• on the online booking website,
• via the ESI central booking platform.
Reservations are confirmed subject to availability.
During school holiday periods, advance booking is strongly recommended.
The Client may book for themselves or for third parties, and guarantees that they have authorization to use the relevant personal data.
Registrations are personal, nominative, and non-transferable.
8.2 Payment
All services must be paid in full at the time of booking.
• Online bookings: payment by credit card only.
• On-site bookings: credit card, paper ANCV holiday vouchers, or cash.
8.3 Order Confirmation
The booking becomes final after:
• full payment,
• validation by the ESI School.
A lesson card is then issued to the Client or sent electronically.
Any order constitutes irrevocable acceptance of:
• the prices,
• the selected services,
• these GTC.
9. Online Bookings – Technical Liability
The ESI School is subject to a best-efforts obligation regarding access to its website and booking platform.
It cannot be held liable for malfunctions related to the internet network, computer viruses, service interruptions, or any event constituting force majeure.
10. Right of Withdrawal
In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to leisure services provided on a specific date or during a specific period.
11. Modification and Cancellation of Services
11.1 Cancellation by the Client
Reservations may be cancelled up to two (2) full weeks before the start of the lesson.
After this deadline, any cancellation or withdrawal by the Client will not give rise to any refund or rescheduling.
For remote bookings and/or paid by credit card, administration fees of €15 per lesson will be retained.
No refund will be granted in particular in the event of:
• insufficient physical or technical level,
• interruption of services beyond the control of the ESI School,
• cancellation decided by instructors for safety reasons,
• schedule changes related to ski lifts.
11.2 Modification or Cancellation by the ESI School
The ESI School reserves the right to modify or cancel a service in the following cases:
• insufficient number of participants,
• unforeseen unavailability of an instructor with no immediate replacement,
• safety reasons or operational constraints.
Group Lessons
If the minimum number of participants required for a group lesson is not reached, the ESI School will offer, subject to the Client’s prior agreement, to convert the service into a shared private lesson at a rate of €50 per person for 2 hours.
If the Client does not agree, the service will be cancelled and refunded.
For remote bookings and/or paid by credit card, administration fees of €15 per lesson will be retained.
Shared Private Lessons
If a shared private lesson includes fewer than two participants, the service will automatically be converted into a one-hour individual private lesson, at the same price, with no additional charge to the Client.
Cancellation Without Alternative Solution
Where no replacement solution is possible, the ESI School will issue a full refund for the service concerned, with no entitlement to any additional compensation.
12. COVID-19 or Similar Health Situations
In the event of official restrictions (administrative closure, quarantine, travel bans, closure of ski lifts, etc.), services will be:
• rescheduled where possible,
• or refunded in full or on a pro rata basis.
Outside of these situations, no cancellation or refund will be granted unless a cancellation option has been taken out in advance.
13. Prices
Prices are stated in euros, all taxes included.
They do not include:
• insurance,
• equipment,
• ski lift passes.
The ESI School reserves the right to modify its prices at any time.
In the event of an obvious pricing error, the order may be cancelled and refunded without compensation.
14. Performance of Services
The Client undertakes to:
• provide accurate information,
• comply with the instructions given,
• arrive on time at the specified meeting place.
Any delay or absence will not give rise to any refund.
15. Image Rights
The ESI School may use photos and videos taken during services for communication purposes.
The Client may withdraw their consent in writing at any time, allowing the ESI School a reasonable period to adapt its communication materials.
16. Liability
Except in cases of gross negligence or intentional misconduct, the liability of the ESI School is limited to the amount paid by the Client for the service concerned.
Liability is limited to direct, proven material damage.
In the event of an accident caused by a third party, the ESI School and the instructor have no obligation to identify said third party.
17. Personal Data
Personal data is collected solely for the management of services and in compliance with applicable regulations (GDPR).
The Client has the right of access, rectification, objection, and deletion, which may be exercised by mail or email addressed to the ESI School.
18. Force Majeure
In the event of force majeure, performance of the services is suspended without liability.
Services may be rescheduled for a period equivalent to the duration of the impediment.
19. Applicable Law and Disputes
These GTC are governed by French law and interpreted in the French language.
In the event of a dispute, after first contacting the management of the ESI School by registered letter with acknowledgment of receipt, and in the absence of a satisfactory response or no response within sixty (60) days, the Client may refer the matter free of charge to the consumer mediator, whose contact details are available on the website:

20. Final Provisions
The invalidity of any clause shall not affect the validity of the remaining provisions.
Failure by the ESI School to exercise any right shall not constitute a waiver of that right.
